Digging Deep: Tips for Finding Your Spouse’s Assets

Asset Search

Sometimes it is important to start with a comprehensive asset search in your divorce case. An asset search will give you a general lay of the land regarding any property your spouse may have an interest in, any vehicles, any liens they may have, any licenses. Several issues can be addressed if you just initially do an asset search to find out what your spouse is tied to.

Subpoena

During a divorce, subpoena powers are key. If your attorney subpoenas records for your spouse, the third party that they’re subpoenaing the records from, they are court ordered to provide those records to you. You can subpoena employment records, mortgage records. You could subpoena records from Cash App, Venmo. Quite frankly, there’s any number of places you can subpoena for records from your spouse once a divorce case is filed and if you have an attorney that can do so.

Employment Records

Employment records tell a story about what it is your spouse has regarding their income and any other benefits through their employer. They will also typically provide you with the information for any retirement plan administrators and any other like rollover accounts that your spouse may have had rolled into their current employment retirement plan. You might want to start with a good employment record subpoena, so that you can know what your spouse’s current benefits are if they refuse to disclose that information to you during discovery.
