Packing your Parachute: Preparing for Divorce

Speak with an Attorney

It is very important that you speak with an attorney at the outset. Namely because a lot of the times people have misconceptions about what their rights are regarding property, regarding custody, regarding interest in their assets, or interest in their spouse’s assets. An attorney can properly discuss what your interests are and assets regardless of how those assets are titled, what your interest might be regarding custody, and what your game plan should be moving forward and obtaining a divorce from your spouse.

Gather your Documents

Once you’ve spoken with an attorney, you’ll have a better idea of what information you may need to help move forward with your divorce case. As I’ve said, some spouses have no idea where their spouse is employed, how much money they make, or where to even find that information. Speaking with an attorney can guide you on where to start gathering information so you can prepare for your divorce in a more efficient fashion. Once you’ve started gathering documents, you must make sure you maintain that and that you keep gathering information about your spouse’s bank accounts, credit card accounts, liability accounts, and assets so that you will have the most updated information possible as your divorce proceeds.

Finalize your Exit Plan

It’s important to understand what your exit plan will be and it’s completely different for some people. Some people, it may make more sense for you to stay in your home and follow the appropriate documents. Other people, it may be important for you to leave. It may be important for you to come up with a parenting agreement or mediation. It’s usually very, very case and fact specific, so you need to talk with an attorney before you make your exit plan so you know what will help you and what may hurt you and what things to look for and what things to avoid.
